View Full Version : Search Warrant and Police Harrassment

I was working at my second job. My son let his friends in my house. They were supposidly smoking marijuana. Cops were called on loud music complaint, all though person in nearby area stated to the media the neighborhood was quiet. I was called at my job by a different neighbor who told me that she saw my son handcuffed laying face down on the ground with a gun pointed at him. I was like oh my God what did he do. When I arrived, I arrived to see 9 - 12 police cars and vans parked in front of my house. You would of thought that was a real serious problem. I was told by the lietuenant that my son had admitted to smoking weed, and asked me if I they could do a search/ they also asked my son and he refused. I told them they could if they didn't make a big mess, she said she couldn't promise anything. I said no, and why does this warrant a search warrant anyways. She said the police entered the home and saw a homemade bong and a box of baggies. They were never given permission to enter the home. All though they kept telling us to leave which we wouldn't. My son started to walk to meet one of his friends parents he said he turned around and cops just ran through the house. He never gave permission to them to enter the house and there were no reasons to believe there was any danger. No weapons were found on anybody or any other reason that they need to enter the home under special circumstances. If they didn't they would not of even been able to get the search warrant. Oh they also came to the door which is not visible from my living room ( there is small wall blocking view ). My son just went to the door and saw a shot gun and two hand guns pointed at his head, he slammed the door because he didn't realize it was the police. When they finally announced who they were, he opened the door. Everyone left the house. Everyone got searched. I also believe there was additional evidence planted in the house by the police. First the police told me they found 3 baggies of weed in the microwave. In the complaint it said 2 in an envelope were found on top of microwave and one in my sons courier cabinet upstairs. I believe the small bag in my sons room was planted there using the baggie they recover from one of the kids outside of the house. They removed a small quantity of weed from my house. A One Way Sign and a No Parking Sign that was given to him by a police man like 7 years ago when some of friends did work for him when they were like 12. The policeman bought an old abandoned church and was renovating it, and there were signs in the basement and he told the kids they could have them. They removed a bong and a pill cutter that had marijuana residue in it. They also took my computer tower because they said that it was near a piece of paper that looked like it had gang signs drawn on it in the summons, in person they told me it was because the bong was near the computer which it wasn't it was near the tv. Oh and they remove a picture that my son drew like when he was 14 that said SH-201 and had a gun drawn on it. They said it looked gang affiliated. Well when they pressed the charges against him I asked if he needed a lawyer because they said the weed is either yours or your mothers even though none of it was his. She said since I opened my mouth I am getting a summary arrest also. They gave the duplicate of what charges my son had. They even put the part in there where he told them he was smoking weed on my complaint against me. I wasn't even home and I definitely would not admit to smoking weed when I wasn't. I would had to of smoked well I was at my job. I feel like my son has been harrassed repeatedly by the police since we moved here. Everytime him and his friends would play basketball, the cops would show up, if there was music on. If there were to many kids, even for scratching there balls. It was offensive to the neighbor. My son also was held up at gun point by the police a couple months ago, well he was walking to work at 8 am the police told him to stop and put his hands behind his head. They grabbed him threw him on the police car and searched him. There reason was someone heard gun shots, I found out later there were no calls on gun shots, a police told me that a car was stolen but that was on the other side of the neighborhood. Do we have any rights what so ever? Is there anyone who can help us?

Just a point of view, every county in Arizona has a search and rescue generally associated with the Sheriffs office. Please look into what they have and how we can be a usefull part of the solution.
