I'd like to know what, if any, options are available in this situation...
NY state employee, completing 2year probationary period & everything's proceeding smoothly unitl about ~22+ months into it (that is almost the end of the probation). suddenly there's a meeting with supervisor & supervisor's supervisor to discuss "issues, complaints, traineeship status". This was not a meeting that was given any forewarning about to discuss "issues" in any informed or thoughtful manner.
Had gotten approval for some time off within a couple of weeks (the same leave process being implemented since started there & same policy being used by others there including immediate supervisor). Anyway, probably the stress of this flared up a chronic condition, so took a couple of sick days (always keeping in touch with employer to let them know). When it wasn't improving by the third day, went to doctor, followed medical advice, & got note for employer.
Meantime, employer informs that now the previously approved leave would be considered unauthorized so cancel all the arrangements. When returned to work in a couple of days, another meeting now with supervisors & hr, again without forewarning to say "not living up to potential & want to help you succeed...will have another meeting to discuss progress". So supervisor had written something up at last meeting that she adds a paragraph to (mainly spin & distortions). Was shocked to see that & said that wasn't there in our last meeting; "oh yes, I sort of thought to add some things...can you sign". Felt intimadated, coerced, & stunned; like a dummy did sign. Later that day, wen to HR & voiced concerns that they were not discussed at the meeting & didn't feel comfortable with that paragraph there (not like comfortable twith the rest of it either); HR person gives strong reassurance that should expect to complete probation.
Few days after that, supervisor calls to say "we're goign to extend your training another 50days for the time off you took so you get the training you deserve". Called HR next day to ask how calculated amount of time off & they said, sure come down to talk. Turns out anther undisclosed meeting with the HR person & her supervisor. And turns out, allowed 40days of leave during 2years of probation; had taken 10days of approved leave+ personal days (that have to take or they expire) + the sick days. However HR supervisor counted the state-mandated holidays (like christmas, thanksgiving, etc) over this probation in this total time off taken & came up with some number like 49.
So, if they want to fire me, why don't they just do it? I'm probationary not permanent.
And if I need more training all of a sudden, that's their deficiency, isn't it?
And there's a difference between "probation" & additional training!
And, is there anything to say about changing the leave policy of an approved leave rather than grandfathering it? Isn't there some legal term for changing procedure in the middle (?"in media res")?
Is there anything I can do? Any recourse? Any suggestions if should fight this or just swallow everything & be compliant?
