My friend is living with her boyfriend an american citizen for almost 3 years, she is undergoing a divorce, the boyfriend has just finished with his. They had planned to get married so she will get a green card and also easier for her to get her child (16 years old) who is in her home country. The boyfriend promised her marriage and was willing to adopt her child the reason why she filed for her own divorce. The ex husband is not an american citizen. She only has a working visa.

The boyfriend changed his mind when he discovered that he will lose his alimony from his ex wife if he decided to marry his gf.

Now she is in a dilemma, she really wanted nothing but to get a green card so that she can get her kid and live her permanently. If they marry outside US like Mexico border, would that be also considdered binding? Can there be like a pre-nuptial agreement or something if they get married? The boyfriend is retired and 72 years old and they are living on the alimony checks they get from the ex wife. The gf got no job right now until her divorce is finalized. If they get married he would lose the alimony and even if the girl get a job somewhere it won't be enough to support her, her kid and the boyfriend/husband. What else can she do if not for the marriage option? She earned the promise since she has been taking care of the older boyfriend. Or would it be better for her to go marry someone else that can provide her that security of a green card? She really wanted to stay with the boyfriend, they had been together for that long but she wanted to get her daughter over here too. So that is her problem right now. I hope anyone can give her the best advice on what to do and what steps to take.
