I work for a very small community bank. We lent money to a customer, Carl, to purchase a vehicle from his sister-in-law, Kim. Kim neglected to inform us that we already had a loan against the vehicle which was being sold. Carl didn't inform us of this fact either and may not have known. Carl is now in default on the vehicle and we intended to reposess, however, the title is still in Kim's name and her loan is still not paid off. Can we have Carl and/or Kim charged with fraud in connection with these transactions? Can we sue Carl for not providing the title to the vehicle as stated in the loan terms? Any help is appreciated as we can't afford to keep a lawyer on retainer.
