I am in need of some advice for an insurance claim that had no benficiary. My father passed away a few years ago and my mother did last year. After she did I found an active policy for my father. I called the company and they said that it is only payable to the estate. My parents did not own anything of worth. At the time of my fathers death he was in a nursing home and my mother was renting a home. At her passing, she was in a nursing home. I am in only child and I do not feel that I need to open an estate just for this policy of less then $6000. Can you tell me if I can do this. I found this excerpt from a PA COde that states.....
(d) Life insurance payable to estate. - Any insurance company which upon the death of an individual residing in this Commonwealth owes his estate a total amount of $11,000 or less under any policy of life, endowment, accident or health insurance, or under any annuity or pure endowment contract, may at any time after 60 days following his death pay all or any part of that amount to the spouse, any child, the father or mother or any sister or brother of the decedent (preference being given in the order named) provided that at the time of the payment no written claim for that money has been received at the office of the company specified in the policy or contract for the receipt of claims from any duly appointed personal representative of the decedent.
Please give me some advice.
