View Full Version : Bank did not credit account when transaction was cancelled

Hello all,

My mother was using a GE Money bank walmart money card. Her check was being deposited onto this card. She attempted to withdraw money from her account, the transaction was approved however when the money was supposed to come out of the machine the atm wigged out and said service unavailable transaction cancelled. So she thinks cool, I'll go to another atm but when she tried to withdraw it said insufficient funds. She has gone round and round with GE Money bank of whom the card is under. When she called initially they said she had to file a dispute by mail and would take 15 buisness days to receive. When contacting them again she called to inquire about the dispute letter but was told it was never received. Since she didn't send it by certified mail there was no proof she sent it. So she again sends another dispute letter by certified mail. When this letter is received they mailed her a letter back that said she was not within her 60 days to dispute the transaction. My question is legally can this bank take her money when they were the ones who were at fault for not depositing the money back into the account after the cancelled transaction? She even had proof from the bank who owns the atm that the transaction was cancelled and they did not receive the money. GE Money bank has told her that they are not liable for this because the merchant has the funds but she mailed them a letter and copy of the transaction from the bank stating they did not take the funds. What can she do about this? She has submitted complaints to the attorney general and better buisness bureau. We're talking about $400 here which might not seem like a lot to some but my mom is a single mom taking care of my teenage sister on one income. She can't really afford an attorney. I just feel bad for her because to me it seems unfair. Can a bank really take money like that?
