View Full Version : Suing credit card company for disputed charge?

I purchased some furniture in Aug 2005 at Levitz on deferred billing. One of the items was never delivered , because they announced later that fall they were going out of business. I was told to dispute the amount of that item, a table, with the credit card company (HSBC). I have spent the last 1-1/2 trying to get someone at HSBC to help me. They just keep sending form letters saying their position remains the same, and my account was never charged for the table. They keep sending me screen shots of their system saying that I was only charged for $2,311.39 worth of furniture according to their records, which does not include the disputed table. And this would in fact be correct, except that the monthly bill I receive says I am being charged $2,614.06, which just so happens to be their amount plus the cost of the table. For some reason, in the year and half that I have been dealing with Customer Service at this company, I can not get one person to see that there is a discrepancy. I am starting to believe that is willful, and that they are trying to drag this out until the deferred billing period ends in December 2009. If not paid in full, all the finance charges will come due. My question is, do I have any way to sue in small claims before the deferred billing period is up? Or do I need to pay the amount first, then sue them and hope I see the refund? This is only about $275-$300 and I know there is cost involved in small claims court, but the principle of this really burns me.
