My daughter is at the end of her lease July09. She is leasing a 2 bedroom apartment with a roommate. I am moving my daughter out of the apartment on the 25th of July09. Can I enforce her roommate to move out the same day. They were also served an eviction notice on the 10th of this month due to her roommate having a puppy which is a violation of the lease. I want her out the same day as my daughter. Can I legally enforce this?

Unfortunately, you don't have any control over whether or not the roommate leaves.

If your daughter signed the rental lease at the same time as a tenant, they are each responsible for the actions of the other in terms of the law. However, you may be able to have a separate conversation with the landlord and see if you can convince him to not follow through on the eviction of your daughter (and you as the co-signer). Speaking as a landlord/property manager myself, I can tell you that we do understand that this kind of thing happens and sometimes exceptions can be made. You also need to know that you (as a co-signer) are also responsible for the actions of your daughter's roommate in the eyes of the law.
