I was injured as a result of a car accident, of which the other party was entirely at fault. The insurance company sent me a form for me to recover my lost wages, as a result of the accident. One of the questions on the form is-what was my gross weekly salary at the time of the accident, which was $800/week. Another question is what was my gross earnings from this same employer for the past 52 weeks. Since I didn't work for this company for the full 52 weeks prior to the accident, how will the insurance company determine my lost wages? Will they only count the months I worked for them, and then divide 52 into this number to get a comparative less average weekly wage amount, of which would be considerably less than my full-time gross earnings of $800/week? Or will I be entitled to be compensated at my full-time earnings of the $800/week, regardless of the fact I hadn't worked for the company for a full 52 weeks prior to the accident?
