:confused: what is the law on a robbery i got 12 years ago. the incident occurred at a major department store where i live. it was not realy a violent crime but i did get into a scuffle with a female sstore security guard on my way out of the store and because of this confrontation with store security they charged me with robbery when in all actuality i probably was more like a petty theft if even that. it was more of a struggle type of fight with security no weapons whatsoever were ever invoved. at my sentencing 12 yrs ago i was told i had a silent strike but no mention of any strike is on any court documents in regards to this case. i am now being charged with petty theft w/a prior because of the robbery they are saying i have a prior and also they are charging me with a 2nd strike. someone told me that even though there was no record of any strike i have a strike on my record because even though it does not say it robbery is an automatic strike period. i have been in no trouble at all in the last 12 yrs. i am worried sick as i have a 4 year old child who is vey dependent on me and this would be traumatic to him if i were to go to jail for any length of time i was told i am looking at 32 months and if they strike my robbery case a 2nd time they can add 2 more years to my sentence because of the strike. please answer immediately as i go to court tommorow aftrn . thank you, t. thomas. p.s. my new case i accidently walked out of a store with a neclace worth 40 dollars in my hand .
