My cousin has a comm. property that he listed with my another cousin (never do business w/family), where she did absolutley nothing with it besides take pictures and put her signs on the property. It now been over a year and he has since told her he wasn't selling. She told him she would have someone come by and take the signs, which she did. He has now hired a new Real estate agent to list the property, but he's telling him he can't touch it because she hasn't released him. What does that mean? And is she entitled to a cut once he sells it? The property is appraised at 1,000,000. Thank you in advance.

Most Likely to which the new agent is referring is that the old agent has not submitted a cancel listing agreement to the MLS and removed it from the MLS database. As long as the listing is active on the MLS, the old agent will be allowed a commission if the property sells. Also, make sure that in the cancellation agreement, the old agent submits a list of people which they are working with. IF the property sells to one of those people in the next 90 days, they still get a commission.

Thank you for your help. I was able to look at the contract today, which is dated 5/05 to 12/05. My cousin tells me that in Jan 06 she called him to ask him if he wanted to continue the listing, he said he told her "ok". I asked him if he signed on for another year? He said no contract was signed, just a verbal agreement over the phone. Then he told her he wasn't going to sell, and she picked up her signs. So with the MLS # on the 05 contract I tried to look it up on the net, as well as on her site. I'm not showing it listed, which means it's inactive right? Now the 05 contract reads:Mid-Fl Regional Mutiple listing service, so does this mean she puts the property on here and is able to list it on several places? Actually this is what you were referring to when you said "list of people", right? I really appreciate your help.

can anyone recommend a good real estate lawyer for closing in a new condo development? mine is charging 3000 and i think its a bit steep since i have read somewhere that most charge 1500. HELP
