I am currently facing a 30 day jail sentence for Driving While revoked. I have a "companion" ticket of illegal possession of wild game animal. I was not observed driving when I go this ticket and I did not poach the deer that I was cited for. I was on a managed hunt and killed a small spiked deer which measured 1 inch longer than the states legal limitations for the deer to be considered a doe. The antlers were un noticable in the woods when I killed the animal so I flagged down the first park ranger I seen and explained the situatiuon. Well long story short I was cited for Driving while revoked and illegal possession as I was the only person in my party but I did have a vehicle in the parking lot.
I was initially given a recommendation of $1,000 in fines plus court costs but I fell short of the total on court day - I showed up with $900 of the $1,200 total and was informed by the judge that my plea was set aside as I "Did not do what I was supposed to do." I then hired an attorney as the judge explained to me that I was looking at jail time. The only attorney that I could find was more expensive than I could afford really but I tried to make it work. Eventually I was unable to make my payments to him in full so he dropped my case. Before he dropped my case however he had reached an agreement with the prosecutor for 10 days on each charge in the county jail to run consecutavley. But since my attorney dropped the case this recommendation was yanked from the table.
I am now forced to rely on the public defender as I lost my job due to these tickets and I have not had ANY luck at all finding a new job in the current times especially since I do not have my dirvers license. I am eligible to get them reinstated but it will cost me near $2,000. The best recommendation that I have gotten from the Public Defenders office is 30 days in jail with a $250 fine.
So boiled down I have one pissed off prosecutor who is angered that I have used my rights without deviation but I have nearly exhausted them. This prosecutor is taking this very personal which is virutally impossible to prove. But he is trying to "make an example of me." My question is do I risk hiring another attorney in hopes of a better deal in turn pissing off said prosecutor even more or do I just take the 30 days and deal with it?
