View Full Version : Someone repo's the wrong truck ... Mine!

Hello everyone, I'm new here, found this place with google. I have a long story, and I'm still typing this while I'm mad:mad:

This all started last night. I got home about 10:30 p.m. and started making a bite to eat. I noticed a big truck pulling into the back yard. So I went out to see what was up. Any of you ever watch that TV show Operation Repo? This would have been a good show for them to film what they do wrong! It's not the same repo company as on TV, but I tried to explain to them that they were making a mistake. They had the right VIN# but the wrong name and finance company on their paper work. I called the sheriff and they sent a man over right away. He got out of his car and would not even look at the paper work that they had. I tried to explain to them that they had the wrong guy! She sheriff said there was nothing he could do and drove away. I took down all of the info I could... Name and address of the guy they were looking for. As it turns out, he was the previous owner of the truck. I googled his name and had him on the phone less then 5 min. after the repo guys left here with my truck. So I called my banker who has a lean against my truck and he said I should be contacting a lawer. I called the used car dealer who I bought the truck from and they had all the paper work proving that they had payed off the loan when the guy traded in the truck. The dealer said I should sue all of them including the sheriff. I've never sued anyone before, and I don't plan on sueing the sheriff ... I'd like to see them change the way they help people in the future, but I would like my loss of wages covered for not being able to get to work today because of this mess. Someone is at fault ... It's not me, I pay my bills. Who could be held liable, the other finance company or the repo company? And do you even think I have a case?

Please help ... I don't know what to do :(

BTW~ I settled out of court for $5,000.00
