I need advise. Prior to the start of my class last semester, my Prof Stated that if you don't past a sub test of our cause after the 3rd trial, you will not be able to get the 5% grade that comes with the test. Unfortunately, I did not pass and now he is threatening to kick me out of my final semester if I don't pass it for the 4th trial. Now without this 5% grade I did well enough to pass the class. However, on December, 19th 2009, after I have gone to him to discuss my situation, he made me sign a form saying that if I don't pass the test by January 9th, 2010 I will not be allowed to proceed with my finally semester.
Background Info
1. I had already pass this same class previously and because it is a nursing program if you come back to finish the program you need to edit the class (meaning you have to participate in all classes and pass all exams). However what ever grade you get for the edit class is not going on your transcript. At the same time you don't register for the class but you are allowed to attend the class because you have already completed it.
2. The class outline stated specifically that this sub-test is 5% of you final grade and you don't get a grade after the 3rd trial
I would like to know my legal standing if he still insist on kicking my out of the program because I still have not passed this test. I still pass the class without the 5% grade but she still want to kick me out of the class. I will appreciate any advice.
