My fiance and are have been trying to complete out his divorce but we were given a different ammount owed than what is on the divorce decree. He is now being told by his soon to be exwife that her lawyer says that the ammount owed was 1700(rough estimate) but since he didnt have the money to pay it at the time that she is willing to resubmit the divorce and add on another 700 for charges. Bring the total to roughly 2400, we hadnt contacted because everytime we try to contact her or the wife does she adds more money to the invoice for contacting she adds anywhere between 100 to 50 dollars if she is emailed or checks her voicemail.
We contacted the clerk of court in our city and they informed that the divorce is on file and that there would be no need for her to resubmit if nothing has changed, all they would need to have is verification that the amount was paid and that he could be divorced in 30 days.
Does her lawyer have a legal right to recharge him for the divorce if the ammount is still 1700 and nothing has changed from the original decree?
