I am currently renting my house out to someone in the service. His lease is up in June, but he has been given orders and will be leaving the country in May. He got married a couple of months ago and wants to renew the lease with the option to buy when he gets back. We have discussed this in the past and it might be an option, but I'm hesitating because he does not have a good payment history. He is always late in paying rent (no, I don't charge him late fees, although stated in the lease late payment conditions...and yes, I should be charging him). My questions:
1. If I do not renew his lease, does he have any legal options against me since he technically left for the service before his lease was up?
2. If I do renew, it would be for 18 months while he is away on duty. What if his wife doesn't pay on time? Do I have any legal recourse?
The reason I'm asking is because I have a friend in the military and she told me that no legal action could be taken against him while he is out of the country and I don't want to be caught in a bad situation. Suggestions would be WONDERFUL.
