Pre-emptive Overdraft Fees

I was wondering if it was legal for my bank to charge me overdraft fees for items they 'think' will overdraft my account when in fact it is their removal of fees that causes my account to become overdrawn and everything after it bounce and therefore cause more fees.
Any help would be great.
