View Full Version : Turning in a non filer

Hi Y'all, My question is this.....I know that my ex husband hasn't file a tax return since 2003. We were married until 2005. I filed for 2005 as a single person based on what little financial information I had and I paid taxes as I was supposed to that year. I'm concerned about the years '03 and '04 and dont' want to be held liable when the IRS catches up with him. I'm sure it's only a matter of time until they do. I had no idea, until our divorce, that he hadn't filed those taxes. Does it seem wise for me to turn him in to the IRS for non payment and risk putting my own neck on the proverbial block? I'm thinking that if I turn him in then perhaps I can work something out with them to limit my liability, but maybe I'm wrong about that. I just want to get this dark cloud away from me. I'm tired of having it hanging over my head.

This is a multi-faceted Q and may have more than one answer so here are a couple basic ideas:

You didn't mention if "You" had any income in "03-04".

If NOT and hubby didn't file returns it's too late for him now to claim you on a joint return unless your willing to sign it. (unless taxes were stipulated in the divorce decree.)

It is NOT mandatory for married people to file a joint return.

However, if you DID have income and didn't file,depending on the amount earned, "you" may still be able to file on "yourself" or "you" may not need to file at all.

However, check the IRS rules, it may also be past any statue requirement for you to do so.

If you "Didn't" have any income. Enjoy the rest of your life. Hubbys taxes are his problem.

Thanks for your response. To answer your question, we owned our own business so, technically, I didn't earn any income at all. I don't have access to those records anymore either. He kept them all and locked me out of them as soon as I filed for divorce. The only stipulation I had put in the divorce decree about taxes was that for the years he didn't file while we were married, '03 and '04, if there were taxes owed the responsibility fell solely to him and if there was a refund due us, he was to split it with me 50/50. I don't know that the IRS would really care what the decree says though if they want their "pound of flesh", as it were.

Again, I genuinely appreciate your kind response.
