i am on probation for posession of a controlled substance and have a seach clause. at about 4:30 in the afternoon as i was turning into a shopping center i saw a cop behind me. he followed a short distance then turned off. I parked my car went into the store i was heading which was an aquarium store,made my purchases one of which was filtered water for my fish that i had a bucket for .They fill it outside in front of the store.i did not see the officer then. i put the bucket in my car locked it and started to head for another store when the cop pulled up and asked my name. He then said he was going to do a probation search ,I complied .He found nothing then put me through a number of tests to see if I was under the influence. He arrested me due a high pulse rate saying that he wasn't going to violate my probation just arrest me for under the influence. In the car I saw on the screen I was listed as a pedestrian stop. When I got out of jail i saw that in addition to the under the influence I was being charged with dui . can they do that ?
