I have done everything right. I filed my twenty day notice on time, I filed my Mechanics lien on time, I foreclosed and filed a law suit against the owner of the property two years ago. Its finally coming to court and I get a letter from the opposing attorney stating:
"The property you filed your mecahnics Lien on has foreclosed by the mortgage company and has been sold to a third party, so therefore your lien has no effect and is moot." :confused:
My question is, does not my lien have to be satisfied before the property can be sold or transfered? What happened? Do I have recourse against the Mortgage Company for selling without satisfying my lien?:mad:
