HELP!!! In February of this year my fiance sold his 'beater' of a car to a "friend". At the time the 'friend" was struggling to provide for his family so we decided to do the "good samaritan" thing and allow him to take the car for $150 and the understanding that he would continue to make payments until the full $400 was paid (not a LOT of money but less than we would have gotten had we sold it to someone else) At that time my fiance signed the title of the vehicle over to the friend - and watched his family and himself get in and drive away ((Yes I know - first question - why didnt he get payment plans signed ---- or any form of a loan agreement in writing - too little to late)) In November we received a letter from the district court 3 counties away stating that my fiance had failed to appear in court on a traffic violation for a car that was ticketed for being parked in the streets without a license plate - this had been mailed to an incorrect address - hence the failure to appear along with a fine of $150 and a threat to suspend his license if the matter wasnt taken care of (He has a commercial license for employment) At that time we tried again contacting the 'friend" who had been giving us he run around and the 'I'll have the money next week' for months -- phone is disconnected - last known address is bad! So we contacted the courts and let them know the situation, they inturned replied with a lower fine and the suggestion that we contact Secretary of State. The next day we went to the local Secretary of State who did confirm that by VIN # of the vehicle (which would be how it was ticketed since there was no plate) the vehicle still legally belongs to my fiance, which means the 'friend" never took the signed title to Secretary of State and had the vehicle placed in his name. They then stated the only thing we can do is try and track this person down and go WITH them to the Secretary of State office to have the vehicle transferred - otherwise until then my fiance is legally responsible for the vehicle and anything that happens in it or with it. Sooo my question is --- what now?? Can we report the car stolen? Do you we go and try and locate it and 'repossess" it? HELP!!!!! Its going to cost us more to cover the tickets, etc., than what we made on the vehicle.........
