.My local sheriff's office is trying to auction my property. The mortgage company won't return my calls because my name is not on the mortgage. My local assessor's office mis-filed court documents and a mortgage was given on property that I own half of. The sheriff's office says that my claim on the property is inferior to the mortgage and will proceed with the auction. Does anyone have any advice? Here is my story:
During my divorce , my ex was granted the mortgage free property .
The Judge ruled that my ex owed me the sum of $60,000.00. He ordered my name back onto the title of the home. My ex filed an appeal to the State of Louisiana Appeals Court.
During the appeals process my ex and her husband applied for and were granted a mortgage for the full amount of equity ($93,500.00) in the property. It was not disclosed to the courts or any parties involved that my ex and her present husband, had mortgaged the home during the appeals process. The appeals court ruled to uphold the Judge's decision in my favor and my name was re-placed as 50% property owner. My ex and her husband filed for bankruptcy and has since abandoned the property. I remain listed as 50% property owner on record and I am in the process of purchasing insurances for this property since at this time there is none. I have paid property taxes for 2009 and have been caring for the property since it was abandoned.
