I could not figure out how to post in the right section so please move this post where it needs to be and thanks in advance for any help.
My grandfather died without a will. He has approx 7 acres and a home
located in Pope co. ILL. He was survived by 2 daughters. He has been
dead a number of yrs now and the property has not been probated.
Several yrs ago we were having problems getting the money for the
taxes and 1 acre was sold to my brother to cover the taxes. This acre
has not been deeded as the property has not been probated. My brother
is now requesting the acre be deeded. In addition there has been
issues with a neighbor over property lines. Here is what the 2 sister
wish to do if possible. 1) deed the acre to my brother. 2) by mutal
consent of the sisters they want to make certain that the older sister
will have to house to live in as long as she lives. As it stands the
way we understand it if 1 sister dies then 1/2 of the property or the
property value will pass to the husband and children of that sister we
would like avoid fighting within the family which could possible end
up forcing the older sister out of the house. 3). If the older sister
dies she wants all of the property to pass directly to the younger
sister. We were told several yrs ago that if the property were
probated now that it would be dievided between the sisterws and their
husbands at that time that would have meant 1/4 to each ?????? want to
know if this is in fact the case. The older sister is no longer
maried. 4). If the youger sister dies then 1/2 of the property will
pass to her husband. Please read carefully and ask whatever questions
you need to ask. We need to know exactly what would have to be done to
accomplish these things and also please remember the money is problem.
