Can a job decide not to hire me after I've worked for them over 8+ mnths and they start a hiring process and they do a criminal background check and i have a drug abuse misdeamenor that occurred over 3 1/2 years ago and I only had to pay $125.00 in fees and fines and no jail time. (All the cops found was two dime bags and they weren't even mine because i wasn't driving my car.)

Unfortunately, this situation is 100% legal. My brother encountered a similar situation only his involved a domestic violence misdemeanor. If at any point a prospective employer determines that your background places you as a risk or liability then they can terminate or refuse permanent employment offers. They are in the business of protecting themselves against potential lawsuits due to negligience. If they hire somebody that has a negative background that could impose a liable situation, then they are subject to having a gross negligience lawsuit on their hands. Remember one thing, even though it may suck huge balls, the court found you guilty. Whether you are or not is irrelevant in the eyes of your prospective employer. Sorry dude. It sucks but its the way it is. There is hope however. Did you plead guilty? If you did then after 5 years it can be expunged provided there are no additional offenses. If you plead not guilty, then you can petition the court to expunge it from your record if there are no other offenses. Ya gotta pay through the nose to an attorney though.
