I have a five year old son andnhe has to go to his father's every other weekend. This so called father has not paid child support in over two months and also has a fairly large amount of back child support due. My question is Do I really have to keep sending my son to this deadbeat? I could not get a straight answer from my old lawyer. My child custody papers say that he has visitation rights but they also say that he is to pay child support monthly. To help aggrivate the case the father has moved away and his grandmother and mother now take my son on the weekends he should be with his father. I would just like to know if I can legally keep my son away from all of them because I am not recieving any child support.

You are most definately able to stop visitations. You will however have to appear in court to do so. All you need to do is file a motion to modify child support and custody. Since the father is not paying and is in arrears, there is a very good chance that the judge will award you full custody especially since the father moved away.

Good Luck!!!
