My husband and I separated in May. He decided to stay with the woman he had been having an affair with for 3 years. The woman in which he has been having an affair with is a registered sex offender. He has moved all of our furniture into her house and pratically lives there. He only uses his parens' house as a place of residence when he has our son. We have no legal custody arrangements. To top it off I found out I was pregnant with our second child in april and then he left weeks later. He has been seeing our son regularly and has overnights now 3 times a week despite my protests. He wants to take the unborn child overnight after 2 weeks.
My intentions are not to keep the father from seeing the children. But I do not agree with overnight visits. Our son has developed severe separation anxiety as a result. Is his relationship with the sex offender enough to grant me sole physical custody or at least primary custody? Second, can the father take a 2 week old infant overnight without their mother without the mother's consent? I have not pursued legal action in fear of the father getting total joint custody. What should I do?
