View Full Version : Do I have grounds to get her charged with Child Pornography?

I have recently found some photographs that my soon-to-be-ex-wife took of our children back in July and August. She sent them to me in a big bundle of photographs. I just started to go through them. I found some very inappropriate pictures taken of my children. She has taken very explict photos of my girls. She photographed them running around in a daycare, in the nude. She also photographed my 3 year old playing with her genitals.

According to Minnesota Statute 617.245 (e) " '[s]exual conduct' means any of the following if the depiction involves a minor: ... (3) masturbation or lewd exhibitions of the genitals". According to Statute 617.246 (f) " 'Pornographic work' means: (1) and original or reproduction of a picture, film, photograph, negative, slide, videotape, videodisc, or drawing of a sexual performance involving a minor". According to Statute 617.247 Subd. 4. "Possession prohibited. (a) A person who possesses a pornographic work or a computer disk or computer or other electronic, magnetic, or optical storage system or a storage system of any other type, containing a pornographic work, knowing or with reason to know its content and character, is guilty of a felony and may be sentenced to imprisonment for not more than five years and a fine of not more than $5000 for a first offense and for not more than ten years and a fine of not more than $10000 for a second or subsequent offense." And then it states in Subd. 6 "Consent. Consent to sexual performance by a minor or the minor's parent, guardian, or custodian is not a defense to a charge of violation of this section."

Now, my question is, do I bring this to the police and have them deal with it? Or do I bring it to a lawyer and have them bring it up in civil court as grounds for an OFP against her for our children and then bring it up as criminal charges? Do I have anything at all with this mess? I am very concerned about my children being in that household. I can't have my children constantly exposed to this kind of abuse. What can I do?
