I am being taken to small claims court over money that I withdrew from my bank. I had taken a job online and received payment from a client. I deposited it in my bank and got a statement of when the funds would be available. So, when the funds became available, I withdrew and sent elsewhere. I have all the emails from the company, the client who sent the check, the information on where the money was sent and who picked it up, and the finding from the police investigation.
I am also aware that I can't have an attorney present in Small Claims Court. But, doesn't the bank have to be represented by an attorney? How is that going to be legal? Can they do that? Is there anything else I might need to prepare for my case?
