View Full Version : abandoned Vehicle claim against my car

:confused: I'm not sure if I am posting this in the correct forum, but here is my situation....My son was using my car to go to GA Tech in Atlanta. He parked my car in a parking lot that was near a night club he attended. Apparently this was a tow away zoned parking lot. When he left the club, my car was gone.

We called 75 different towing companies that morning to see if it had been towed and no one seemed to have it. I told my son to report it as stolen. Now, 3 months later, I just received notice that the car is being listed as abandoned and has been sitting at a towing company that told us they didn't have it. They will sell it after 20 days if I don't pay their amount on the letter. This amount is for 125.00 towing fee 1215.00 storage fee, 41.50 court cost, and 138.12 for notification fee.

What is up with this. They tow my vehicle, tell me they don't have it when called that morning, then contact me 3 months later wanting an exorbant amount of money to get t back.

I don't understand why when they contacted the Div of Motor Veh that they weren't informed that this vehicle had been reported as stolen. If they had been informed that fact, i don't believe they would be trying to say I abandoned it.

Basically, I am wanting to know if I have any legal grounds to attain my car without having to pay all these ridiculus fees they want for having my car for 3 months without letting me know sooner. We had went and helped our son purchase his own car 2 weeks after we thought this car had been stolen as he needed a way to get around Atlanta. This mess has caused us hardship financially and now they are wanting to cause me more. What can I do?

By looking at all the other posts listed under traffic law, I am obviously not going to be given advice through this forum. I did however contact a local lawyer for advice. He told me that this happens all too often to people and that I needed to go to Atlanta and file a complaint of my own with the magistrate court there. That since I had not been contacted promptly, that I would likely win my counter suit and could perhaps even receive damages for the loss of use of my vehicle. I contacted the towing company and told them if someone in charge didn't contact me by the days end, that I would be in Atlanta tomorrow to file a complaint in court. Within 20 minutes, the owner called me and told me if I would pay $240.00 for the towing fee and 6 days storage, that I could receive the vehicle. I agreed to this amount and my son is on his way to get it as I type. I hope this helps others in this situation.:)

Glad this was resolved. I was just going to tell you that normally they will reduce the fee in a situation like this...especially since you were not all to blame. Glad you got the car back and your life can go on in peace.

If you can prove you contacted this towing company, (use your phone bill to show you called the company), you have grounds to pay only the amount of the towing and the time it was impounded in the lot before you called them.

States my vary, but if you use the reasonable man theory, they should accept this argument.
