View Full Version : Trustee question when siblings don't get along

My husband and I are currently living with his mom in her home. We sold our home and are her caregivers as she can no longer live alone. Her home and assets are tied up in a trust with my brother-in-law the successor trustee after mom dies. My brother-in-law is also executor of her trust. My husband is a beneficiary only......unless his brother predeceases him, at which time my husband becomes trustee. My husband and my brother-in-law both have full power of attorney over mom.....not joint. My question is this.....since my husband and his brother do no get along and my brother-in-law is out of state, will we have a potential problem after mom dies if my husband is not a trustee? Could his brother tie things up and drag things out just to make us miserable? It's such a shame when siblings can't get along and we have done nothing to diserve the treatment we have received since taking over care for mom.
