I am looking to get some legal advice concerning security deposit agreements between housemates. My roommate and I each paid into the security deposit, however the full amount of the deposit came back to me when we moved out. She wants half of the check, but i dont think she is entitled to half. What is my legal obligation to send her "half" when there are things in the appartment she should have been responsible for.
We had no written agreement to split the deposit, but only a verbal agreement that we would equally maintain the unit and pay equal rent.
(She did not equally maintain the unit):
She completely trashed her bedroom rug which needed to get replaced, and left a bunch of her belongings behind when she left which needed to get removed. She also had her boyfriend living in our appartment, even after i told her he shouldnt be there.
Am i entitled to take out what i think is fair for the security deposit?
Would i be entitled to charge her back rent and utility fees for theft of services of her boyfriend living at my house?
