I need to know that if I ws to go to New Mexico and take my son would that be aganist the law? I am his birth mother and I want him in my custody. please help!

Were you/are you married?
If yes,
follow your existing court orders/state guidelines for relocating the child.
If not...
Has paternity been established (through the court)?
Are there ANY court orders? Child support? Visitation?

If you are the legal guardian and are still married, you can legally take your child anywhere you want. If you are getting a divorce, then you need to follow your court order. In some states you can only move within a few counties.
Now here is a twist that I would like to get an answer on.
The legal mother leaves the state with a child. Tries to establish residence by registering her car and getting that states driver license. She files for divorce and is told that the case is pending but she needs to stay in the state for 6 month. Upon hearing of this, the father files a day or two later in the state that the mother lived in for the past 20 something years. Where would the divorce be pending? The state she moved to with residence pending the 6 months or the state where the father filed?
