View Full Version : Battery and Challenge to fight in public

i was involved in a mutual altercation of violence two months ago with an individual who threw coffee all lover me and my car. his claim for doing this was that i didnt slow down enough for him and his family as he crossed the street. i got out of the car very distraught and he dodged over to my car to insult me and threaten me (baseball style, coach yelling at umpire in the face). before i knew it both of us were tangled up and on the ground. luckilly people came to separate us and seeing him still irate and trying to charge at me. at this point my wife and i left the scene.
i sustained a torn ligament on one finger and a broken finger on the other hand. i went to the hospital and told the nurse the whole story just as i am doing in the forum. they said they would forward that info to the police dept.
a few weeks later a detecitve showed up to my apartment to get my side of the story and tells me that the other individual is pressing charges. obviously he had gone to file a police report, something i didnt bother to do myself! anyhow the city attorney just sent me a letter with an arraignment date to face two charges: battery and challenging to fight in public. what recourse do i have at this point? can i press charges still as a kind of defense? please advise.
